Personal Injury Protection (PIP) PDF Print E-mail

Florida is a No-Fault State. This means if you are injured in an accident having to do with a motor-vehicle, YOUR insurance is responsible for the first $10,000.00 in medical (also provides disability and death) benefits, regardless of fault in the accident.

Often times, one who is injured in an accident assigns their rights and benefits under their PIP coverage to their medical provider, be it an ambulance, hospital, doctor, or diagnostic facility for x-rays or MRI.

Regardless if you are the injured person, or the medical provider, we can help you obtain these benefits or if necessary, sue to recover the full and proper amount due and owing.

PIP generally pays at 80% of twice what Medicare pays for the same service.   You are also entitled to recover the reasonable cost of transportation to and from your doctor at 80% and lost wages or loss of future earning capacity at 60%.

Determining which carrier is responsible for PIP can be tricky.  Generally, YOUR insurance policy will pay your PIP.  If you are the owner of a registered vehicle in Florida, you are required to have PIP coverage on yourself and that vehicle. This wil cover you and any household resident relatives.  If you own a vehicle and fail to have PIP coverage on yourself and that vehicle, you MAY NOT claim the tort exemption under Florida's No-Fault rules and YOU are responsible for your own medical bills (unless the other driver is at fault - call us if you need help here, too).

If you do not own a registered vehicle in Florida, and do not have PIP, you should be covered by ANY policy of insurance proividing PIP coverage to any resident relative by blood or marrige in your household.  If this does not apply to you, then you may obtain PIP coverage from the policy which insured the vehicle in which you were in (host vehicle), or as a last resort, pro-rata from the insurance carriers of any or all of the vehicles involved in the crash.
