Alimony Legislation Dead for 2017

A hot topic in Florida for the past few years may be dead on arrival for the 2017 session.

The anticipated overhaul to Florida’s alimony laws was shut down when a  Senate committee refused to hear the bill. The chair of the Committee on Children, Families, and Elder Affairs was not interested in hearing SB 412 in this session. Furthermore, the House version, HB 283, has not been heard either.

Therefore, any changes to these laws will likely have to wait until the next session. What does this mean for divorces involving alimony? Because both bills sought to heighten the standard by which alimony is awarded, courts will only have to consider those factors under the current law when making a determination of whether alimony applies.
